FourTheKidz Consulting & Tutoring, LLC Enrollment Agreement ("Agreement") is entered into between Mrs. Kimberly Brown and you, the ("Parent"), for the Math Success Program to tutor your child ("Student") in accordance with the following terms: 

SECTION 1: PROGRAM CONTENT AND DURATION 

Program content will include topics related to positive mindset development, goal setting, foundational math skills, test taking strategies, problem solving, and homework help. 

While this 10 week tutoring program has a track record of helping students make significant progress, we cannot guarantee specific results. Progress can vary depending on various factors, including the student's commitment and individual learning needs. Therefore, while we strive to provide the best possible support and instruction, we cannot promise or guarantee any specific outcomes. 

Small group lessons are one hour in length at predetermined times. One-on-One Individualized lessons are available.

DELIVERABLES 

The parent & student understands and acknowledges that the membership in the FourTheKidz Consulting & Tutoring, LLC 10-week Math Success Program entitles the student to the following: 

*2 online classes per week 

*2 parent conferences 

*Pre & Post Math Diagnostics

*Parent access to our Facebook Group

Section 2: Parent and Student Agreement 

The parent and student agree to enroll in FourTheKidz Consulting & Tutoring, LLC 10-week Math Success Program with the following conditions: 

Timely attendance and participation in all scheduled in-person or online tutoring classes per month. 

Completion of required quarterly assessments 

The parent and student agree that all videos, content and material from the sessions mustn't be shared outside of the group. 

FourTheKidz Consulting & Tutoring, LLC 10-week Math Success Program reserves the right to revoke the students/parents access or terminate the membership agreement if these terms are violated. 

Section 3: Tuition

The member agrees to pay these fees which may be paid by automatic debit or credit card transaction with details supplied to FourTheKidz Consulting & Tutorong, LLC  will be paid in full. 

Parent represents and warrants that (1) the billing information that the Parent supplies to FourTheKidz Consulting & Tutoring, LLC is true, correct, and complete, (2) Parent is duly authorized to use such accounts, cards, or funds for the purchase, and (3) charges incurred by the Parent will be honored by its credit card company, bank and other account providers. 

Payments are final, non-refundable and transferable. No student will be allowed to attend without successful completion of payment and/or any tuition fees. 

Clients will not be reimbursed or entitled to make-up lessons if they miss a session. 

Section 4: Payment Plan Authorization & Agreement

By selecting a payment plan, I authorize  FourTheKidz Consulting & Tutoring, LLC to securely keep my credit/debit card on file and charge the agreed-upon tuition in three (3) scheduled payments. The initial payment is due at registration. The remaining payments will automatically be processed on Mondays according to the payment schedule established from the date of the first payment.

I understand that an email confirmation containing my scheduled payment dates will be sent after enrollment. By submitting this form, I agree to fulfill all scheduled payments and understand that enrollment in the program constitutes a legally binding financial agreement with FourTheKidz Consulting & Tutoring, LLC. 

Failure to complete payments may result in suspension of services and/or collection efforts for the remaining balance owed.

Section 5: Respect for Others Clause Respect Policy: 

At FourTheKidz Consulting & Tutoring, LLC, we are committed to providing a safe and inclusive learning environment for all students. To ensure that everyone feels respected and valued, we have established the following guidelines: 

Respect for Others: 

Students are expected to treat each other with respect, kindness, and consideration at all times. This includes refraining from bullying, harassment, discrimination, or any form of disrespectful behavior, whether in-person or online. 

Reporting Violations: 

If a student experiences or witnesses any behavior that violates these guidelines, they are encouraged to report it to FourTheKidz Consulting & Tutoring, LLC 's support team immediately. 

Reports will be kept confidential, and appropriate action will be taken to address the issue. 

Consequences of Violation: 

Violation of this policy may result in disciplinary action, including but not limited to suspension or termination of enrollment. 

By enrolling in FourTheKidz Consulting & Tutoring, LLC, students and parents/guardians acknowledge and agree to abide by these guidelines. They understand that failure to comply may result in consequences as outlined above.

Section 6: Acknowledgement of FourTheKidz Consulting & Tutoring, LLC Intellectual Property Rights 

Student and Parent acknowledge the ownership by FourTheKidz Consulting & Tutoring, LLC of all copyright, trademark, service mark, know-how, trade secrets and other intellectual property rights in the Program content. Student & Parent acknowledges that Program content is for individual use only and agrees not to copy, sell, reproduce, record, share, teach, give away or otherwise divulge Program content without the express written consent of the FourTheKidz Consulting & Tutoring, LLC.

Reproduction or distribution of Program content is strictly prohibited. Student and Parent acknowledge that a breach of its agreements regarding  FourTheKidz Consulting & Tutoring, LLC's intellectual property rights will cause irreparable damage to the   FourTheKidz Consulting & Tutoring, LLC and its goodwill, the exact amount of which will be difficult to ascertain, and the remedy of monetary damages will be inadequate. 

Accordingly, the Student and Parent agree that in the event of a breach of its agreements regarding the FourTheKidz Consulting & Tutoring, LLC's intellectual property rights, in addition to any other remedy that may be available at law or in equity, FourTheKidz Consulting & Tutoring, LLC shall be entitled to specific performance and injunctive relief. 

Section 7: Right to Use Name & Likeness 

Student and Parent irrevocably permits, authorizes, grants and licenses  FourTheKidz Consulting & Tutoring, LLC and its affiliates the right to my photograph, likeness, voice, and or quotes or excerpts of my written or verbally expressed words, my first name, and testimonial for any lawful purposes, including publicity, marketing, and promotion of FourTheKidz Consulting & Tutoring, LLC and its programs without restriction or limitation as to geography or time. 

Student and Parent waive any right to inspect or approve the product or material in which my Likeness may be used. 

The Student and Parent agree that FourTheKidz Consulting & Tutoring, LLC is and will be the sole and exclusive owner of all right, title, and interest in and to the above referenced materials, including all copyrights and any other intellectual property rights therein. 

Student and parent assign to the FourTheKidz Consulting & Tutoring, LLC any right, title, and interest, including any copyright, in the above referenced materials. 

Section 8: Miscellaneous Terms 

(a) Governing Law and Remedies. This agreement constitutes the final, complete, and exclusive statement of the terms of the agreement between  FourTheKidz Consulting & Tutoring, LLC and Parent pertaining to the subject matter of this Agreement and supersedes all prior & contemporaneous understandings or agreements of the parties, whether verbal or written. 

If any provision of this Agreement is invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions will not be affected. This agreement shall be governed by the laws of the state of Georgia.

(b) Federal Holidays. FourTheKidz Consulting & Tutoring, LLC observes all federal holidays in the United States. Live classes are not offered on these holidays. 

Students may attend an additional live lesson during the same week. Please note, additional live lessons will not be provided to compensate for any missed instruction due to personal vacations taken during this week. 

(c) Class Action Waiver. Each party waives the right to litigate in court any claim or dispute as a class action, either as a member of a class or as a representative. Any court action hereunder shall proceed solely on a n individual basis. 

(d) No Waiver. No waiver by either party of any default will be deemed as a waiver of any prior or subsequent default of the same or of another provision of this Agreement. 

8. Use License

a. Permission is granted to temporarily download one copy of the materials (information or software) on website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

I. modify or copy the materials;

ii. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

iii. attempt to decompile or reverse engineer any software contained on the website;

iv. remove any copyright or other proprietary notations from the materials; or

v. transfer the materials to another person or "mirror" the materials on any other server.

b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

9. Disclaimer

a. The materials on the website are provided on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

b. Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

10. Limitations

In no event shall we or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the website, even if we or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
